MachineShedFred writes "A lawsuit has been filed against all the county District Attorneys as well as the Attorney General of Oregon to block enforcement of a new law that restricts the sale of 'sexually explicit' material to people under the age of 18. Powell's Books (who claims to be the largest independent new and used bookstore in the world) as well as Dark Horse Comics (publisher of Frank Miller graphic novels) as well as many other bookstores claim that the new law would be impossible for these businesses to comply with. Amazon.com sued the state of New York and its governor over its new tax law, called by some the "Amazon Tax." The law claims that Internet retailers with affiliates residing in New York must collect New York sales tax because those affiliates count as a physical presence, a claim Amazon rejects.

Overstock.com, the online seller of excess inventory, sued New York state over a new law requiring more Web retailers to collect sales tax on shipments to residents in the state. The suit, filed Friday in state Supreme Court in Manhattan, challenges the constitutionality of a statute requiring Web companies with no physical presence in New York to collect taxes. Amazon.com sues New York over sales tax law

Charging that New York State’s recently amended sales tax law is “invalid, illegal and unconstitutional,” and that it unfairly targets Amazon.com, the retailer has filed suit in the state’s Supreme Court to overturn the law. The new law would require Amazon, and potentially some other online retailers, to pay taxes on online purchases by New York residents.

Quanta Decision Illustrates Case Against Specialized Patent Court

I agree with Mike that the Quanta v. LG decision was a big victory for common sense in patent law. I think it's worth taking a step back to note that this is a continuation of the trend that Mike identified last year. This is at least the fourth time in as many years that the Supreme Court has taken a patent law case, and in every case they've overruled a bad decision by the US Court of Appeals for the Federal Circuit, which has jurisdiction over patent appeals. The Federal Circuit has spent the last 15 years making a mess of patent law, and the Supreme Court has finally started to notice and is working to clean up the Federal Circuit's messes. But it's hard because patents are one of a handful of major issues on its docket, whereas the Supreme Court has lots of other subjects it needs to deal with.

Everyone seems convinced Steve Jobs will announce a new iPhone next week at WWDC and the speculation is wild as to what new features it will include: 3G cellular support, GPS, new design, etc. While I'll admit the evidence is strong that a new phone will be introduced -- one cannot ignore the low supply of the current model or indicators like AT&T's "no June/July vacations" memo to staff -- I am not convinced this new phone will be radically different from the current model.

Law Professors Want New Trial for First RIAA Trial Win - Making available issue could lead to new trial but not necessarily new outcome

Last fall RIAA got a big win in the courts when Jammie Thomas was ordered to pay over $200,000 in fines just for “making available” music downloads for sharing. Recently, the judge in that case said that he was considering giving that trial a second chance because nationwide cases indicate that solely making the files available for distribution (with no proof that they were actually distributed) isn’t actually a crime. A group of lawyers has submitted a brief for the judge’s review which does indeed suggest that a new trial should be granted because of this issue. This doesn’t mean that Thomas would be in the clear; she could still be found in violation of copyright infringement even if a new trial is granted but she would get a second chance to prove her side of the case.

The Virginia Court of Appeals has ruled that the state law against soliciting a minor for sex over the Internet is constitutional. Dean Robert Podracky was convicted of breaking the law in Virginia Beach. New iPhone 3G

We’ve all been hearing a million different things about this “new” iPhone that is suppose to be coming out any day now! I recently spoke to one of my friends who works at AT&T and I guess the new gossip going around is that the new iPhone is going to be cheaper than the original. I don’t know about you guys, but I find this hard to believe. The 3G is suppose to be faster, have GPS, a new glossy black cover (that is said to be color changeable), slightly thicker, updated software and the camera is expected to be better. I’m sure there will be a ton more things that will be changed or newly added to the new iPhone, so it’s a little strange that Apple would make the new iPhone less expensive...Especially, because people are going to buy it no matter how much it is.
