An anonymous reader writes "ZeroPaid is reporting that ISPs could be turned into the copyright police through European legislation that received a number of "intellectual property" amendments. Many of these amendments can be found here. Judging by the amendments, ISPs could be mandated to block legitimate traffic in an effort to 'prevent' illegitimate traffic. alphadogg points us to a NetworkWorld story about the search by ISPs for new ways to combat the web traffic issues caused by P2P applications. Among the typical suggestions of bandwidth caps and usage-based pricing, telecom panelists at a recent conference also discussed localized "cache servers," which would hold recent (legal) P2P content in order to keep clients from reaching halfway around the world for parts of a file. "ISPs' methods for managing P2P traffic have come under intense scrutiny in recent months after the Associated Press reported last year that Comcast was actively interfering with P2P users' ability to upload files by sending TCP RST packets that informed them that their connection would have to be reset. UK ISPs have settled their long-running dispute with the music industry over illegal file-sharing in a new protocol agreement back by the government. The government had threatened to impose legislation on the industry if it did not reach an agreement on self-regulation. The agreement includes the ISPs Orange, BT, Virgin, Tiscali, BSkyB and Carphone Warehouse. The deal will see the ISPs send letters to customers when their account has been identified as having been used to unlawfully share copyrighted material. The letters will point consumers to other sources of material available legally and in a variety of formats. ISPs and rights holders will also together produce a Code of Practice on how they will deal with alleged repeat infringers, and the government will consider ways to give the code legislative underpinning.

JagsLive informs us that the electronics retailer Newegg.com is defying New York lawmakers; it has suddenly stopped collecting sales tax from New York online shoppers. The "Amazon tax," which went into effect June 1, requires online merchants to collect sales tax if they have any affiliates in the state. Amazon is complying but has sued the state on constitutional grounds. Overstock.com dropped all of its New York affiliates and then joined the Amazon lawsuit. Newegg started out complying with the law on June 1, but stopped collecting taxes for New York on August 21. Last fall RIAA got a big win in the courts when Jammie Thomas was ordered to pay over $200,000 in fines just for “making available” music downloads for sharing. Recently, the judge in that case said that he was considering giving that trial a second chance because nationwide cases indicate that solely making the files available for distribution (with no proof that they were actually distributed) isn’t actually a crime. A group of lawyers has submitted a brief for the judge’s review which does indeed suggest that a new trial should be granted because of this issue. This doesn’t mean that Thomas would be in the clear; she could still be found in violation of copyright infringement even if a new trial is granted but she would get a second chance to prove her side of the case.
