Blizzard Tries To Forbid Open Sourcing Glider

ruphus13 notes a new development in Blizzard's case against MDY, which we discussed last week. Blizzard, the maker of World of Warcraft, has now requested another injunction — to prevent the open sourcing of Glider code. Quoting: "Blizzard has asked the court for a relatively unconventional order prohibiting MDY from making the source code for its MMO Glider software available to the public, and prohibiting MDY from helping people develop other World of Warcraft automation software. Blizzard had previously asked the court to shut down MDY's WoW operations in its motion for summary judgment, but the court's summary judgment order did not address Blizzard's request. Blizzard's requests to prohibit open-source release of MDY's software and prohibit MDY's assistance in development of independent WoW bots are new to this motion — and seem

Applied Nanotech Holdings, Inc. Announces Court Decision

Applied Nanotech Holdings, Inc. (OTCBB: APNT) announced that the U.S. Court of Appeals for the Fifth Circuit issued its opinion in its litigation with Canon, Inc. The appeals court in part affirmed, and in part reversed, the rulings of the district court. While the appeals court accepted, without deciding, the district court's decision that SED, Inc. as originally formed did not qualify as a Canon subsidiary, and that Canon had materially breached the contract, it found that termination of the license agreement was not an appropriate remedy. The appeals court also ruled that the restructured SED, Inc., which is 100% owned by Canon, now qualifies as a Canon subsidiary. The appeals court denied Applied Nanotech's appeal that the district court had improperly excluded certain evidence from the trial.

Time To Close The ITC Patent Injunction Loophole

For quite some time, we've been pointing out how patent holders have been using a bit of a loophole to get two separate shots at getting an injunction against other companies in patent disputes. This became even more popular after the Supreme Court ruled in the MercExchange case that injunctions banning the sale of goods often did not make sense. The loophole is that, rather than go through the court system, patent holders would go to the US International Trade Commission, claim that the goods they believed were infringing were an "unfair trade practice" and demand an injunction against importing them into the US -- effectively the same thing as a court injunction against sale (assuming the good was manufactured outside the US).

Blizzard-Activision Merger Official

The Washington Post's Mike Musgrove is reporting that the Blizzard-Activision merger is official as of yesterday afternoon. "One analyst has predicted that the merged company would make $1.38 billion in profits during its first financial year, enough to make Activision Blizzard the world's largest game publisher. [...] But this merger should give the newly-formed company enough heft to compete with EA for such blockbuster projects, said Pachter. 'It's good to have a duopoly instead of a monopoly,' he said. 'This just makes the industry that much more interesting.'"

Guitar Hero Makers Want to Compete With iTunes

After selling 20 million copies and earning over a billion dollars, Activision Blizzard, the creators of Guitar Hero, think the next logical step for the franchise is to open up an iTunes-like digital music store. “I don’t think there have been a lot of credible alternatives to iTunes, but Guitar Hero certainly has that potential,” Bobby Kotick, chief executive of Activision Blizzard said, adding that “the natural evolution” of the franchise would be to create an online music platform. Activision Blizzard was formed yesterday as the result of the merger between Activision (the company behind the Guitar Hero franchise) and Vivendi Games, the group responsible for World of Warcraft and the gaming arm of the company that also owns Universal Music.

Court: 'Violating Copyleft Is Copyright Infringement'

IconA federal appeals court has overruled a lower court ruling that, if sustained, would have severely hampered the enforceability of free software licenses. The lower court had found that redistributing software in violation of the terms of a free software license could constitute a breach of contract, but was not copyright infringement. The difference matters because copyright law affords much stronger remedies against infringement than does contract law. If allowed to stand, the decision could have neutered popular copyleft licenses such as the GPL and Creative Commons licenses. The district court decision was overturned on Wednesday by the United States Court of Appeals for the Federal Circuit.
