Telecoms Suing Municipalities That Plan Broadband Access

Law.com has up a review of ongoing and historical cases of telecoms suing municipalities that plan broadband networks. In many cases those same telecoms have spent years ignoring as potential customers the cities and towns now undertaking Net infrastructure projects, only to turn around and sue them. One lawyer who has defended many municipalities in this position says, "This is similar to electrification a century ago when small towns and rural areas were left behind, so they formed their own authorities." Bob Frankston has been writing for years about the financial model of artificial scarcity that underlies the telecoms businss plans. This post gives some of the background to the telecoms' fear of abundance.

Functional Testing

JMeter is found to be very useful and convenient in support of functional testing. Although JMeter is known more as a performance testing tool, functional testing elements can be integrated within the Test Plan, which was originally designed to support load testing. Many other load-testing tools provide little or none of this feature, restricting themselves to performance-testing purposes. Besides integrating functional-testing elements along with load-testing elements in the Test Plan, you can also create a Test Plan that runs these exclusively. In other words, aside from creating a Load Test Plan, JMeter also allows you to create a Functional Test Plan. This flexibility is certainly resource-efficient for the testing project.

Real-World 3G Monthly Cost With Taxes and Fees?

Kristl writes "I have called AT&T and walked into several AT&T stores to ask 'How much will an AT&T phone plan cost per month with taxes and fees and everything?'. No one can answer this question. They are evasive and become testy when I push them on it. Their answer is they can't tell me what the government is going to charge me as the fees can vary month to month, but I've been an AT&T customer for several years, and my taxes and fees have not varied more than a dollar in all of that time. So I question them: 'Can you just tell me what the taxes and fees will be for a 3G plan in California that has the basic calling plan, basic data plan, and the basic text plan?' I even do the math for them, that's $75. Okay AT&T, what are the taxes and fees on $75? Oh, they can't tell me that, as the taxes and fees can vary from month to month.

You have to sign up for a voice plan when you buy the phone initially, and then you send in the eligibility form to get the plan. [AT&T]

Proposed DOL regs would require enhanced disclosure to 401(k) plan participants

The Department of Labor’s Employee Benefits Security Administration has issued proposed regulations that would require employers and plan administrators, in satisfaction of their fiduciary duties under ERISA, to provide (on generally an annual basis) participants and beneficiaries in participant-directed plans with plan and investment-related information, including details of fees and expenses assessed to their individual accounts. The proposed rules, which, when finalized, would apply to plan years beginning on or after January 1, 2009, would specifically require the disclosure of investment-related fee and expense information (e.g., sales loads, deferred sales charges, redemption fees, service charges, exchange fees, account fees, purchase fees, and the expense ratio for the total operating expenses of the investment) to be made in a
