Racketiciel writes "A French user asked for a refund after buying an ASUS computer that came with Windows XP and other software pre-installed. ASUS tried to apply a procedure which cost more money to the consumer that they will give back... The court ruled in favor of the user, who received back 130 Euro (~200 $) for the software. Here is the ruling (PDF, French). In France, this is the fourth victory for refund seekers during the last two years, and many people are now filing for refunds (in French). Two French associations (AFUL and April) published a press release on this victory the same day an important hearing happened." The English-language press release linked above gives a pretty good idea of what happened here, for those unsuited to wading through French.

EBay has been hit with a €20,000 fine after being found liable for counterfeit goods sold on its site. The landmark ruling, which is the first in a long line of such lawsuits, may set a precedent that puts liability on eBay for all counterfeit goods sold on its site in the future. In the latest case a French court found in favour of French luxury group Hermes.

A French court ordered the online auction giant eBay to pay 38.6 million euros, or $61 million, in damages to the French luxury goods company LVMH, in the latest round in a long-running legal battle over the sale of counterfeit goods on the Internet. LVMH, a maker of high-end leather goods, perfumes and other fashion and luxury products, successfully challenged eBay for a second time in the French court, arguing that 90 percent of the Louis Vuitton bags and Dior perfumes sold on eBay are fakes.

Scientists have found that the compound resveratrol slows age-related deterioration and functional decline of mice on a standard diet, but does not increase longevity when started at middle age. This study, conducted and supported in part by the National Institute on Aging (NIA), part of the National Institutes of Health, is a follow-up to 2006 findings that resveratrol improves health and longevity of overweight, aged mice. The report confirms previous results suggesting the compound, found naturally in foods like grapes and nuts, may mimic, in mice, some of the effects of dietary or calorie restriction, the most effective and reproducible way found to date to alleviate age-associated disease in mammals.

StonyandCher writes in about a collaboration between NASA and a leading Australian exploration and mining scientist, Dr. Brent McInnes, to search for signs of ancient life on Mars. The plan is to develop and miniaturize the "Alphachron" — an exploration technology currently employed by the Australian minerals industry to determine the age of minerals. If the Alphachron can be miniaturized, it could fly with the next rover mission set for launch in 2010. "The highest priority is to understand when liquid water was present on Mars. 'The same minerals that can be found in [Western Australia]... can also be found on Mars,' McInnes said. Accordingly, by using the Alphachron to date minerals on Mars and thus tell when liquid water may have been present, it can be inferred when life may have been sustainable near the surface of the planet.

Corrupt links to a Sydney Morning Herald article which begins "The French state and internet service providers have struck a deal to block sites carrying child pornography or content linked to terrorism or racial hatred, Interior Minister Michel Alliot-Marie announced on Tuesday." The article is thin on details, but what it does say is bad enough: "Under the French plan, internet users, via a platform, will be able to signal inappropriate sites and the state, receiving the complaints in real time, will then decide whether the sites are to go on a so-called black list to be passed on to internet service providers to enforce site blocks." It sounds like the perfect way to organize an especially malicious DDoS attack. The French government has never been shy about wanting to "protect" French people by censoring Internet content, though.

The ruling, which marks a first in France, found eBay directly responsible for the sale on its website of three Hermes bags including two fakes, for a total of 3000 euro.
