When it comes to determining liability for stolen trade secrets used by unsuspecting third parties, the question in litigation often becomes who knew what when? It has not always been clear when the statute of limitations for these third-party lawsuits begins ticking. Does it start when the trade-secret owner realizes its stolen intellectual property has been licensed to third parties? Does it begin when the trade-secret owner files a lawsuit against the company that stole the secrets and then licensed them to others? Or does it only begin counting down when third-party users are notified that they possess stolen IP?

Hamburg - Most customers find themselves overwhelmed by the variety when buying blank CDs or DVDs. But they can only tell whether they have bought the right one after burning the CD. If it skips when played or if the data stored on it becomes unreadable, then they realize what a bad choice they have made.

There was a time when WinMX was the king of file-sharing. For a brief time, it was arguably larger than FastTrack (Kazaa, Grokster), eDonkey2000, and Gnutella. But that was a long time ago, when the P2P community actually meant something. When FrontCode Technologies, the company behind WinMX, received a “cease and desist” letter from the music industry in 2005, the entire project was abandoned.

Are you seeing a ghost? It could be. When most people think of the Trifid nebula they think of the wild colored fantasy images they've seen taken with filtered, long exposure photography. But what happens when you combine science with imagery? Just ask Toni Heidemann. Toni may have made his living in Grenoble, France by studying cold neutron backscattering in a spectrometer, but when he retired in 2002 he did the world a favor by turning his interest in h-alpha celestial photography into works of art.

AgaveNectar writes "Doctors are far from being early adopters, so they have just gotten around to publishing a report that webcams help immensely with making the right decision when someone shows up to a rural emergency room suffering from a stroke. Using clot-destroying medications like alteplase is really risky, and it should only be given in acute cases. In a study of 222 patients, rural ER doctors consulted with faraway stroke specialists. They made the right decision 98 percent of the time when the expert examined the patient with a webcam, and only 82 percent of the time when they just talked to each other on the phone. Perhaps this report will finally convince the medical community that telemedicine is important."

spaj writes "In the ongoing battle with the MPAA and RIAA, there seems to be an ongoing argument about who is to blame. If you leave a $20 bill on the sidewalk, can you report it stolen when someone takes it? Of course you can, but will you be taken seriously by the authorities? When my car was broken into, I was told by the responding police officer that I might have prevented it by keeping my seats and visible areas clear of junk that would entice criminals. So, who is at fault when it comes to users abusing their right to capture streaming media for personal use? According to Applian.com's Legal FAQ, the RIAA will not come after you if you make a recording for your own personal use. I have often been torn on this issue, and I am looking for input.

Hugh Pickens brings news that scientists from Penn State have developed a new method for heat-transfer that may replace the common compressor-based system used in household appliances. Quoting: "Zhang's approach uses the change from disorganized to organized that occurs in some polarpolymers when placed in an electric field. The natural state of these materials is disorganized with the various molecules randomly positioned. When electricity is applied, the molecules become highly ordered and the material gives off heat and becomes colder. When the electricity is turned off, the material reverts to its disordered state and absorbs heat. The researchers report a change in temperature for the material of about 22.6 degrees Fahrenheit... Repeated randomizing and ordering of the material combined with an appropriate heat exchanger could provid

Today we are going to look at a very nice case of the iPhone that is also available for the new iPhone 3G. The case is called the Griffin Wave for iPhone. Several colors are available and the case protects the screen and leaves all the controls easily accessible. The edges of the case are beveled so that they are comfortable against your ear and face when the phone is in use. When the Griffin Wave for iPhone is installed, it does add a bit of bulk to the phone, but not much. Obviously, you can no longer place the phone into the docking cradle when the case is on, but the sync/charge cable itself fits with the case installed without any issues.

IconIn these days there has been much fuzzing about the new browsing with files organizing themselves with the help of meta data. Maybe you ask yourself "What have this to do with the spatial browsing in gnome and how can it improve the browsing?". That's what I did. As I see it, the gnome people have introduced the spatial browsing so we are used to it when this new browsing is coming to town. This is very intelligent move of the gnome people and will help us adopt faster to this. This is when the spatial browsing is really making sense. I hope you see this when you've read this article.

Today is a really sad day for me as I have to bring my tongue-cancer-sick kitty to the vet to be put to sleep this evening. It's such a hard decision to make as she's gone downhill in a blink of a second, but the last thing we want is to have her suffer by starving. I adopted Chloe almost 7 seven years ago, when I was living by myself in a studio in Manhattan. Chloe was the best companion for me -- she's mellow and could handle being by her self for long stretches while I was at work, but she also loves affection. She'd greet me by the door when I came home and just gave so much love -- I was never lonely. She literally never swats at you or bites when you go to pet or kiss her. She's a little love bug, that Chloe. Two years ago, I had to let her go in a way because Dan was moving here and is super allergic to cats.

Microsoft rarely sues anyone, but gets sued plenty. It's interesting, therefore, that when Microsoft recently took legal action against an alleged patent violator, the subject is hardware, not software, and relates to its mouse technology, of all things, and not something more significant like, say, its Windows cash cow.
