Under this multi-year agreement, Destiny Media remains the primary, and only company-wide platform, for the global distribution of UMG's pre-release digital media in North America. Universal Music Group (UMG), the world's leading music company, and Gotuit, a leading provider of metadata technologies, announced today that UMG has signed a broad license agreement to Gotuit's intellectual property, which includes six issued patents and numerous patent applications. Under this license, UMG will foster the development of new personalized means for consumers to enjoy their artists' music via satellite radio, HD radio and over the Internet. Financial terms of the agreement were not disclosed.

DJMajah writes "Universal Music Group's case against Troy Augusto, fought by the Electronic Frontier Foundation, has been dismissed by a federal judge. UMG sued Augusto, the owner of Roast Beast Music, over 26 eBay listings of promotional CDs. UMG argued that promo CDs distributed for free to radio stations, DJs and other industry insiders could not be resold; the discs usually carry a label reading 'For promotional use only, not for resale.' UMG asserted the doctrine of first sale does not apply, as the discs were not actually sold and therefore remained UMG's property. The judge ruled that the doctrine does apply because the discs were gifts. The labels indicate no expectation of their return."

Cassin and then filing a new lawsuit aimed at uncovering the identity of the alleged infringer, the RIAA has moved to dismiss another contentious copyright infringement lawsuit. Yesterday, the RIAA unexpectedly filed a motion to dismiss UMG v. Lindor without prejudice. The record companies are, however, asking the judge to impose sanctions on both Marie Lindor and her attorney, Ray Beckerman, who reported the unexpected turn of events earlier today.

Apple Needs More Mobile Music; UMG Demanding Nokia-style Comes With Music Deal?

Have the music labels found a way to get Apple (NSDQ: AAPL) to cave on some of their age-old requests as well as an interesting new one? The NYT’s Saul Hansell reports the Cupertino-based company is deep in “active” negotiations with major music labels to increase the range and inventory of music content available on the iPhone. Specifically, Apple wants to increase its ringtone inventory and to start selling ringback tones. It’s also hoping to hammer out an agreement on whether it can sell songs directly from the iTunes store to iPhones, via the operator’s network. But the music labels have their own list of requests, and are seeing this as their best opportunity to get Apple to relent on some of their eternal demands.
