In a twist, former owners of Rose Art Industries Inc., Lawrence and Jeffrey Rosen, have asked an Ontario court for permission to sue six executives at Mega Brands Inc. over allegations of insider trading. A special independent committee set up by Mega Brands has rejected the allegations after hiring the law firm Fasken Martineau DuMoulin to investigate. The brothers sold their company to Mega Brands for US$350-million in 2005 and have been locked in litigation with the new owners since 2006, when there was a recall of magnets from the Magnetix toy line, part of the Rose Art sale. There were reports of children ingesting them. In the latest legal dust-up, filed on Sept. 10 by the law firm Rochon Genova, the brothers want permission to sue the executives on behalf of Mega Brands in a derivative action, which is relatively rare.
