Lawsuits involving companies upset at competitors buying Google Adwords based on their names have been covered to death, with a variety of court rulings (some good, some awful) over the years. In part due to all this legal activity, Google has cut back on some of what's allowed -- specifically limiting the use of trademarked names from others within an ad if the trademark holder complains. This likely goes well beyond what the law requires. For example, trademark law has always allowed the use of competitive names for comparison purposes. That is, Pepsi can say: "compare Pepsi to Coca-Cola!" and it's not a violation of Coca-Cola's trademark. But, with Google's policy in place, Pepsi can't use that as an ad if Coca-Cola complains.

Apple this week has won a trademark infringement lawsuit against a Chinese electronics company. New Apple Concept Digital Technology Co. was ordered to pay 400,000 yuan (~$58,000 USD), completing a battle between the two companies that began in 2006 when the Shenzhen-based manufacturer was ordered to stop using its trademark, according to China Central Television. New Apple Concept had used a logo that featured an apple with the characteristic missing bite.

Oleg Teterin is a Russian entrepreneur that set out to trademark the infamous online “wink” emoticon, composed of a semi-column, a dash and a parenthesis, to his business, the mobile ad company Superfone. The man says that, since smiley faces such as :-), :) and ;) are also very similar to his trademark, they could also fall under his ownership.

Apple is victorious in a trademark suit! No, not against Psystar, but against a company in China that used an apple logo strikingly similar to the US computer- and gadget-maker's. Apple operates business in China, so it's not surprising that it ran into conflicts with another company trying to use an Apple logo.
