Trade secrets are confidential business information that have value because they are not generally known and are the subject of efforts by the business to keep the information confidential. The most well known example of a trade secret is the formula for Coke. Every company, however, has trade secrets (e.g., customer lists, source code for software, methods of creating products, etc.). Every state has enacted laws to protect trade secrets. There are also federal laws that provide additional protection for trade secrets by way of severe civil and criminal penalties for theft or other misappropriation of trade secrets.

Orange is giving its French iPhone customers incentives to trade up to the new model, according to news from multiple readers of PCInpact. The carrier is described as calling its customers giving them an offer that would encourage them to trade up to the iPhone. One offer would see users trade in their 2G models for the next-generation version as well as paying 50 Euros; a second would let them keep the older model but buy the new one with a "generous" subsidy from the carrier, according to reports.

Russoniello for the Northern District of California. Atul Malhotra, 42, of Santa Barbara, Calif., was charged on June 27, 2007, in a one count information with theft of trade secrets. According to court documents, from Nov. 17, 1997, to April 28, 2006, Malhotra was employed by International Business Machines Corporation (IBM) as director of sales and business development in output management services for IBM Global Services.

Evergreen Solar (ESLR): Stock vaulted from 10.40 to 11.56 late in the first hour of night trade. It dropped back to 11.25, where upside liquidity was strong, and stepped higher through the mid-session, rising from 11.40 to a brief high of 11.85. Sellers funneled in some moderate downside pressure off the top and dropped ESLR to a still positive range of 11.35 to 11.75 - levels where its stayed through much of its second-half evening action. A pre-market open on Thursday looks to have potential near 11.60. We would expect ESLR's early upside trade tomorrow to be a bit overeager as the stock is often a news-driven volume favorite in pre-market trade. With that in mind, longs may want to look for potential entry points close to 11.35 to 11.50, an area that could form as a pre-bell base of support for moves back to 11.
