USAF Violates DMCA, Escapes Unscathed

eldavojohn recommends coverage at Ars on a Byzantine case just thrown out by an appeals court. The US Air Force cracked the code that would expire a piece of software. For this they were sued under the DMCA in Blueport v. United States. The Court of Federal Claims heard it and threw it out. "The reasoning behind the decisions focuses on the US government's sovereign immunity, which the court describes thusly: 'The United States, as [a] sovereign, "is immune from suit save as it consents to be sued... and the terms of its consent to be sued in any court define that court's jurisdiction to entertain the suit."' ... Google Sued For Patent Infringement For Keeping Track Of How Many Ads People Click On

It still seems rather amusing (if not twisted) that some patent system supporters are trying to convince the world Google would be harmed by an absence of software patents. Instead, it seems increasingly obvious that it would only serve to help Google, who is a regular target of questionable patent infringement lawsuits. Take the latest such case as an example. A company by the name of Web Tracking Solutions, which ironically enough, doesn't appear to have much of a web presence (if any), has sued Google for patent infringement, claiming that its patent on third-party on-line accounting systems is being violated by Google's AdSense offering.

I fully support people’s civil rights and freedoms, and regulations that help people with disabilities survive and succeed in society. Still, I sometimes wonder if certain things can go a bit too far. Recently, a blind student sued the retailer giant Target for having a web site that couldn’t be parsed by his special reader…and won, even though no regulations actually exist to control the accessibility of web site content…
