Facebook has won a judgment of nearly a billion dollars—$873,277,200, to be exact—against a spammer who used the social networking service to illegally advertise his wares. California judge Jeremy Fogel ruled late last week that Adam Guerbuez was guilty of violating the 2003 CAN-SPAM Act, and that he should be required to pay statutory damages, aggravated statutory damages, and attorneys' fees to Facebook by mid-December. Even Facebook's lawyers don't believe they will be able to collect, however.

(AGI) – Rome, 26 Nov. – He had flooded the famous social net-working site Facebook with millions of advertising-type messages, and for his troubles the Canadian spammer has been punished with an 873 million dollar fine by a US court. This is no doubt the highest penalty ever inflicted in the history of ‘spam’ (literally the sending of large quantities of unwanted messages, usually advertisements), breaking the preceding record of 230 million dollars awarded against MySpace. In three months, the Facebook user – a Canadian hacker- had attempted to promote products sold by his business, not least encouraging the use of marijuana, using Facebook as a point of access to customers. But the company founded by Mark Zucherberg, which has 120 million users throughout the entire world, reported the IT pirate and the judges sided with him.

Facebook has a won $873 million judgment against a Canadian man who bombarded the popular online hangout with explicit “spam” messages. The victory, sealed with a judge’s order issued last Friday, probably won’t yield a windfall for Facebook. Court records indicate the alleged spammer, Adam Guerbuez of Montreal, has been difficult to find since Facebook sued him four months ago. But Facebook is hoping the size of the judgment will scare off other spammers who might be tempted to target Facebook’s audience of more than 120 million users. Efforts to reach Guerbuez for comment were unsuccessful. The case against Guerbuez and his business, Atlantis Blue Capital, illustrates how Internet rogues can manipulate Facebook’s communications system to unleash massive marketing blitzes.
