With the recent attention to the DHS's draconian policy on laptop searches at borders, a blog post by Steven Bellovin from last month is worth wider discussion. Bellovin extrapolates from the DHS border policy on physical electronic devices and asks why authorities wouldn't push to extend it to electronic data transfers. "...it would seem to make little difference if the information is 'imported' into the US via a physical laptop or via a VPN, or for that matter by a Web connection. The right to search a laptop for information, then, is equivalent to the right to tap any and all international connections, without a warrant or probable cause. (More precisely, one always has a constitutional protection against 'unreasonable' search and seizure; the issue is what the definition of 'unreasonable' is.

Wired is running a story about a case the Supreme Court will be hearing on Tuesday that relates to searches based on erroneous information in government databases. In the case of Herring vs. US 07-513, the defendant was followed and pulled over based on a records indicating he had a warrant out for his arrest. Upon further review, the local county clerk found the records were in error, and the warrant notification should have been removed months prior. Unfortunately for Herring, he had already been arrested and his car searched. Police found a small amount of drugs and a firearm, for which Herring was subsequently prosecuted. Several friend-of-the-court briefs have been filed to argue this case, some calling for "an accuracy obligation on law enforcement agents [PDF] who rely on criminal justice information systems," and others defending

In a relatively short time, Google Images has become a huge source of internet traffic. A substantial percentage of our traffic comes from Google searches, and a rapidly growing segment of that comes from image searches. I was reminded of this once more when I checked the numbers and found that over the past 12 hours, nearly 18,000 people have found their way to Power Line by searching "Sarah Palin" and linking to the "Miss Wasilla" photo that you can see below.
