When Apple Inc. (Nasdaq: AAPL - message board) reported its fourth fiscal quarter the other day it was a watershed event for the company and the wireless industry in many respects. Granted, the revenue was a little on the light side at only $7.90 billion (+27 percent year-to-year; +6 percent quarter-to-quarter) but earnings per share were well above street expectations at $1.26. The earnings gain was essentially a function of the company’s gross margin being significantly above guidance (34.7 percent versus guidance of 31.5 percent) due to lower component costs.

On October 13, 2008, the President signed the Prioritizing Resources and Organization for Intellectual Property Act into law (Pub. L. 110-403) (the PRO-IP Act). The new statute strengthens the intellectual property laws of the United States in several respects. For example, it amends Section 410 of the Copyright Act to codify the doctrine of fraud on the Copyright Office in the registration process. The law also clarifies that registration is not a prerequisite for a criminal copyright prosecution and makes it unlawful (civilly or criminally) to export unauthorized copies of protected works, including copies of phonorecords, from the United States.
