Coming out of one Indian holiday season and headed into Christmas and New Year, Indian magazines and newspapers are full (well, not too full in these tough economic times) of editorial features clearly aimed at getting readers to buy stuff. But what really gets my goat is how many of these features have everything about a product--including very attractive product shots--except, that is, the price.

Ignoring numerous other court rulings concerning whether or not "making available" is copyright infringement, a judge has rejected a woman's request for a jury trial in her file sharing lawsuit, and ordered her to pay the $7,400 fine already set. This was the case we had just discussed last week, where the woman claimed that the RIAA only had evidence that she had shared six songs, even though she admitted to making 37 songs available. There was already an agreement in place that the fine would be $200/song, so the real question was whether it should be $7,400 or $1,200. The woman argued that, in light of the Jammie Thomas mistrial and other rulings, the RIAA needed to show actual infringement, rather than just that the files were made available.

"We've elected to have our port scan start at 80 (The traditional http server port) and grab every other (higher) listening port on the localhost and query all of them, as if they were http servers, by sending a simple HTTP/1.0 GET request. As a blanket request to any number of known, and unknown, ports, it's not always the best way to interrogate, but it does get lots of useful information from any sort of web server and a few other sorts of servers as well. The only thing you have to settle down and be comfortable with is the fact that, a lot of the time, you can find out just as much about what's running on a particular port by reading the error message you receive from a bogus query as you can from reading the result of a successful one.

NAGPUR (Agencies): Ricky Ponting has said he was approached by a senior member of the India touring party during the acrimonious Sydney Test and asked to drop Australia’s complaint against Harbhajan Singh. Harbhajan was alleged to have racially abused Andrew Symonds during the game and Ponting said that even before Harbhajan’s three-Test ban was handed down it was clear the matter would not be straightforward. Ponting’s recollections are revealed in his Captain’s Diary 2008, an extract of which has been published in the Weekend Australian. “On the night after we made our on-field report about Harbhajan, I had a phone conversation with a senior member of the Indian touring party, who asked me straight to drop the complaint,” Ponting wrote.

In that article, Jake had just become the manager of the Eric Landes Fictional Corporation (ELFC) Software Maintenance (SM) group.
