Power Integrations patents applicable vs. Fairchild

Power Integrations said that all four patents asserted by the company in its patent-infringement lawsuit against Fairchild Semiconductor have been found enforceable by the court. Power Integrations was found to have acted properly in the process of applying for and obtaining its patents from the Patent Office and, as a result, the court rejected Fairchild's claims of inequitable conduct and ruled the patents enforceable. In October 2006, a jury found that Fairchild willfully infringed each of the four patents and awarded Power Integrations damages of approximately $34 million. In September 2007, a separate jury upheld the validity of each of the four patents.

A new means to scuttle submarine patents

The late Jerome H Lemelson is well known to numerous manufacturers, not only in the United States but all around the world. During his lifetime, Lemelson, who was the extremely litigious inventor-owner of a large number of patents granted by the United States and many other countries, was also famous for his pursuit of what are known in the United States as submarine patents. The term submarine, which is not unique to Lemelson patents, is based upon the fact that US patents so termed have matured from divisional or continuation applications of parent, grandparent, or even more remote ancestor patent applications filed, in some cases, 20 to 30 years before issuance of the submarine descendant patent.

IP Attorneys Increasingly Getting Their Own Patents And Suing

A year ago, the story of patent attorney Scott Harris started making headlines. While being an IP attorney at a prestigious law firm, on the side, Harris had been getting his own patents, and then using a shell organization to sue companies for infringing. Some of the companies sued were represented by the firm that Harris worked for. Talk about a conflict of interest, right? Well, reporter Joe Mullin has discovered that these sorts of things are increasingly common. Various IP attorneys involved in patent hoarding lawsuits are seeing how lucrative it can be to just get a patent and sue -- and so they're eagerly jumping into the game themselves. Mullin dug up a bunch of cases of IP lawyers getting their own patents, and then suing over those patents, outside of their day job.
