Why Shouldn't Competitors Be Able To Weigh In On Patent Applications?

The patent system is only supposed to grant patents on inventions that are new and non-obvious to those skilled in the art. As we've pointed out in the past, the "non-obvious" part of the requirement has long been (effectively) ignored by the patent office. Instead, it mostly focused on whether the invention was new -- and did so by looking at published examples of prior art. There was very little effort made to examine whether or not the concept was non-obvious, and even less to see if it was non-obvious to skilled practitioners in the field. Luckily, the Supreme Court's decision in the Teleflex v. KSR case brought some attention back to the obviousness question, but only in one particular area (concerning combining two known concepts). However, it did little to actually establish a real test of whether or not a concept is obvious.

Secure File Storage Over Non-Trusted FTP?

To accomplish this, I'm using a script to check timestamps, encrypt and sign the files individually, then copy each file to an offsite FTP directory. I've looked over many different tools (Duplicity, Amanda, Bacula, WinSCP, FileZilla) but none of them seem to do exactly what I want: (1) multi-platform (Windows and Linux), stand-alone client (can be run from a portable drive). (2) Secure backup (encrypted and signed) to non-trusted FTP site. (3) Sync individual files without saving to a giant tar file. (4) Securely store timestamps and file names on the FTP server. Any help or info on alternative solutions appreciated.

Maybe Patent Trolls Wouldn't Be So Hated If We Called Them Patent Elves

I'm not a huge fan of the term "patent troll" which I agree can be unfairly negative, and without a clear definition often leads to problems. Recently, it seems that the term is most often applied to "non-practicing entities" making some people think that the patent system is mainly abused by those operations. That's a bit of misdirection. There's just as much, if not more, abuse of the patent system done by large companies. If there were actual proof (still waiting!) that the patent system actually did lead to more innovation, then I can easily understand why a non-practicing entity that just licensed its works could make sense. Unfortunately, most of the evidence suggests that patents don't actually lead to more innovation. In those cases, the only thing that non-practicing entities end up doing is hindering innovation.

Non-English languages, including Chinese will be used in domain names, which is seen as the most significant evolution in Internet domain names in the past twenty years. All current available domain names will be used up by 2011. ICANN will start accepting applications for new domain names in 2009. The application fee starts at 100,000 USD.
