FBI ISP Letters May Have Violated Free Speech

Anti-Globalism sends in a Reuters account of an appeals court hearing in which an unnamed ISP is challenging the Patriot Act "National Security Letter" provision that allows the FBI to issue secret letters to ISPs and telecoms, demanding customer records. "A panel of federal appeals court judges pushed a US government lawyer on Wednesday to answer why FBI letters sent out to Internet service providers seeking information should remain secret... Between 2003 and 2006 nearly 200,000 national security letters were sent out. Of those about 97 percent received gag orders."

UK ISPs Agree To Help Tackle Music Piracy

The BPI (who represent the Britsh music industry) have agreed on a plan with six leading UK ISPs, which will lead to thousands of net users suspected of illegally sharing music receiving warning letters. The six ISPs who have agreed to co-operate are BT, Orange, Virgin, Tiscali, BSkyB and The Carphone Warehouse. Customers of those ISPs who are alleged of sharing music illegally by the BPI can expect to find warning letters coming to their doors, though there doesn't appear to be any threat of legal action attached to such letters. Consultation has also been under way, which suggests among other things, that serial file sharers could have traffic management imposed on their connections. The BPI itself has gone as far as to suggest a three strike system that would see internet connections cut off for persistent pirates.

Universities Realize That The RIAA Is Taking Advantage Of Them In Lawsuits On Students

We never quite understood why various universities were cooperating with RIAA demands that it send "pre-litigation" letters to students accused of file sharing. These non-binding letters are often used to pressure students into paying fines, even if they're based on weak (at best) evidence of file sharing. It certainly wasn't in any university's best interests to basically help out a private organization in a business model dispute with its students. Yet, some university officials, falsely convinced by the RIAA that this was more than a business model dispute, decided to help out. And the response? The RIAA has increased the flood of notices, and then convinced Congress to move forward on legislation that would legally obligate universities to act as the RIAA's copyright cops.

Multi-Level Marketing Company Threatens Blogger Who Writes Critical Post

Over and over and over again, we hear stories of companies that simply dislike what others are saying about them online, and send over threatening legal letters with no legal basis. These cease-and-desist letters are mostly designed to scare users into giving in, because there's no law against someone criticizing you or saying something bad about you (assuming it's not untrue). The latest, sent in by Davis Freeberg involves the Everyday Finance blog. The blogger there was approached by a company called "Shop to Earn," which offers a multi-level marketing (MLM) system. The blogger wrote a post about it, which Davis Freeberg describes as "well balanced," though the blogger explained the weaknesses of the system and why he chose not to participate.

UK ISPs agree deal on combating illegal file-sharing

UK ISPs have settled their long-running dispute with the music industry over illegal file-sharing in a new protocol agreement back by the government. The government had threatened to impose legislation on the industry if it did not reach an agreement on self-regulation. The agreement includes the ISPs Orange, BT, Virgin, Tiscali, BSkyB and Carphone Warehouse. The deal will see the ISPs send letters to customers when their account has been identified as having been used to unlawfully share copyrighted material. The letters will point consumers to other sources of material available legally and in a variety of formats. ISPs and rights holders will also together produce a Code of Practice on how they will deal with alleged repeat infringers, and the government will consider ways to give the code legislative underpinning.
