What Do You Do If Someone Blows Up Your Satellite? Call a Space Lawyer

As space travel becomes routine and private enterprise gets a foothold in low Earth orbit, it is becoming clear that specialists in the field of space law are required. Until now, lawyers here on the surface have extended their knowledge into space, but there will be a time when terrestrial lawyers will need to be superseded by a space equivalent. For example space lawyers could wrangle who is accountable for the space debris left behind after a satellite gets shot down. What happens if a nation accidentally (or deliberately) destroys another nation's spy satellite? Does this cause retaliation with global consequences or can the dispute be easily settled in "Space Court" with the help of space lawyers? These are extreme examples, but space lawyers may eventually become a part of everyday life for manned excursions into the cosmos.

Social Networking Sites Becoming Useful For Lawyers

chareverie writes "With how the internet has become, social networking sites such as Facebook and MySpace have become a tool for crime solvers, employers, and now, lawyers. Two weeks after Joshua Lipton was charged in a drunk driving case, the college junior attended a Halloween party dressed as a prisoner, with the words 'jail bird' on his costume. Not surprisingly, his prosecutor was able to obtain photos of him at the party that were posted on Facebook, and claimed he was an 'unrepentant partier who lived it up while his victim recovered in the hospital.' The photos were presented in a slideshow, with one of them showing Lipton holding a can of Red Bull in one hand, and an arm draped around a girl bearing sorority letters. The judge agreed with the prosecutor, and changed Lipton's sentence to two years in prison.

While some overly competitive immigration lawyers might derive some pleasure from the recent news that Fragomen, the nation's largest immigration law firm, is having all of its PERM green card cases audited by the Department of Labor, wiser folks realize that the Department of Labor is launching phase two of a broad attack on the right to representation by legal counsel and they've chosen the nation's biggest law firm in order to send a message of intimidation to the immigration bar. Others have done a good job laying out the issues. ILW has a special commentary today on the case. And the American Immigration Lawyers Association has written a scathing letter taking DOL for making new rules by press release and for acting recklessly in issuing a news release with potentially disastrous repercusions before it has concluded an investigation

Bloggings: July 2, 2008 by Joel Stewart

I'm sure the readers of this Blog know that most of the nation's immigration lawyers went to attend the AILA Conference in Vancouver, BC. While at the conference, many of the lawyers there were concerned about the recent instructions from DOL regarding the attorney's role in the labor certification process under PERM.

Judge Refuses To Sign RIAA 'Ex Parte' Order

NewYorkCountryLawyer writes "The RIAA just can't get enough of going after University of Maine students, but it appears that the judges in Portland, Maine, may be getting wise to the industry's lawyers' antics. RIAA counsel submitted yet another ex parte discovery order to the Court ('ex parte' meaning 'without notice'), in BMG v. Does 1-11, but this time the judge refused to sign, pointing out that there is no emergency since there is no evidence that records are about to be destroyed [PDF]. This is the same judge who has previously suggested the imposition of Rule 11 sanctions against the RIAA lawyers, accusing them of gamesmanship."
