Reader Chemisor advances a theory in his journal that a linguistic misunderstanding is at the root of many disagreements over different licensing philosophies, in particular BSD vs. GPL. The argument is that GPL adherents desire the freedom of their code, while those on the BSD side want freedom for their projects. "It is difficult to spend a week on Slashdot without colliding with a GPL advocate. Eager to spread their philosophy, they proselytize to anyone willing to listen, and to many who are not. When they collide with a BSD advocate, such as myself, a heated flamewar usually erupts with each side repeating the same arguments over and over, failing to understand how the other party can be so stupid as to not see the points that appear so obvious and right.

"Interestingly, the CD's Credits file mentions Ralph Yarro, among others. The copyright information states that they used Red Hat's Linux and then added some tweaks of their own to it, and they list files and applications that were not under the GPL, and none of the files in the screenshots are listed as excluded. All the rest, they say, were distributed under the GPL. The Announce file is particularly interesting, because it mentions ELF directly, and that speaks to whether SCO knew what they were distributing under the GPL. I asked Dr Stupid to look at the screenshots and tell me what it means to him, and here's what he told me:

The "Is VMware violating the GPL" question is circulating again (Matt Asay follows up his own post here) so I thought it would be useful to dust off an Illuminata Perspectives that I wrote when this same thing cropped up about a year ago. I've excerpted the most salient points from the original post and added a little updated commentary.

An anonymous reader brings news that the Software Freedom Law Center has published a guide for compliance with the GNU General Public License. The purpose of the guide is to prevent "common mistakes" the SFLC has encountered during its various GPL violation investigations. Their suggestions include close scrutiny of software acquisitions, more precise tracking of changes and updates, and avoiding "build gurus." They also provide tips for dealing with a violation. The full guide is available at the SFLC's website.

A range of people in the open-source community has been pointing the finger at VMware for allegedly creating derivative works of Linux in its ESX virtualization technology without contributing those changes back.

phanboy_iv writes "Fans of both of the Raven classics, Heretic and Hexen, have been trying for almost a decade to convince Raven Software to release engine source code for the games under the GPL, much like the DOOM engine on which both of them are based. Well, they finally did it! Source code is available at Sourceforge. Both of these games have had the source available for a while, but under a restrictive license that hindered ports and modifications. Now, thanks to dedicated fans, that's no longer a problem."

Today the Linux world broke out the champagne to celebrate VMware joining the Linux Foundation. I agree. It's good news. What it doesn't resolve is the allegation that VMware is in active and conscious violation of the GPL. Some of these allegations appear to be well-founded. VMware's lack of response to the allegations is not golden, especially in light of its embrace of the Linux Foundation.

"However, given the history of this issue it is best to receive it with at least some caution. Over an extended period during the passage of DIS 29500 through ISO the shepherds of DIS 29500 were repeatedly invited to make a statement about the OSP’s coverage of GPL implementations. They repeatedly declined to do so, including an express statement of GPL ignorance in the OSP FAQ. As recently as a month or so ago the Australian arm was bravely reiterating the ignorance line."
