eBay said the Belgian Tribunal de Commerce has dismissed all claims by L'Oreal brought against eBay regarding the sale of counterfeit items. eBay issued a statement published on the eBay corporate blog "This is the second successful court ruling in a row for eBay, both supporting our view that controlling prices and distribution reduces consumer choice. Online auctioneer eBay claimed yesterday to have won a Belgian court case against L'Oreal after the French cosmetics giant sued it over the sale of counterfeit goods. L'Oreal has brought cases against eBay in five European nations, including Belgium, accusing the company of not doing enough to prevent the sale of counterfeit goods posted on its auction and sale sites. The Belgian commercial court, the first jurisdiction to deliver a ruling, "has ruled in favour of eBay," said Sravanthi Agrawal, eBay spokeswoman in Europe. The court ruled that the world's largest online auctioneer did not have "a general monitoring obligation" of what was on offer on its site. "The judge confirmed that eBay acted diligently when it received letters from L'Oreal," the spokeswoman added.

Rumors are floating around that eBay (NSDQ: EBAY) is going to lay off about 10 percent of its 15,000 employees, attributable mainly to an analyst at Wedge Partners, a small Colorado investment-research firm. And while the company has refused to comment on it, it makes sense that eBay will do some rationalization of its business considering its declining profits and stagnant traffic. There's a very interesting article via MSN Money about how Amazon (AMZN) is beating up EBay (EBAY). I abandoned eBay (EBAY) as an investment many years ago as it's now a "value play" instead of growth, but have always said I'd love to get a piece of the action of PayPal if they ever spun it off in its own entity. It's essentially a Mastercard (MA)/VISA (V) clone. PayPal is now up to 1 of every 4 dollars of revenue for Ebay, and why they don't create value by doing a PayPal IPO is beyond me.

Last month, GameStop grew and eBay shrank, according to Nielsen Online, at least in terms of unique visitors to computers and consumer electronics shopping destinations. GameStops number of unique visitors grew at a healthy 57% while traffic for two eBay sites in the category fell by about 20% compared to a year earlier. July was a similar story for eBay as the same two sites, eBay computers and eBay electronics, experienced traffic declines of more than 20% from the same time last year.

Reuters is reporting that eBay (Nasdaq: EBAY) is looking to buy a stake in Gmarket (Nasdaq: GMKT), a South Korean online retailer. eBay would be purchasing the stake from Interpark, a South Korean mall operator, but the companies are currently waiting for approval from the Korea Fair Trade Commission.

eBay (NSDQ: EBAY) is in talks to acquire a minority stake in GMarket, a South Korean online auctioneer. The talks are with Interpark Corp., the Korean portal that owns 37 percent of the company. A spokesperson from eBay told AP that there was no certainty a deal would be reached or that it would be approved by South Korean regulators—eBay already owns a South Korean competitor, the aptly named Internet Auction. No deal terms have been announced, although shares of NASDAQ-listed GMarket shot up over 14 percent on the news. In 2006, Yahoo (NSDQ: YHOO) took a 10 percent stake in GMarket, so they’re a beneficiary of this as well.
