LVMH, the owner of luxury brands such as Louis Vuitton and Christian Dior, has launched a $A33 million law suit against eBay. LVMH claims that eBay is being tardy when it comes to ensuring that products promoted on its site as being LMVH brands are genuine. LMVH alleges that 90 per cent of the 450,000 products labelled as being either Louis Vuitton or Christian Dior and offered for sale on eBay in the second quarter of 2006 were fakes. The French court is due to hand down its decision on LMVH's suit on 30 June 2008

French luxury product manufacturer LVMH, whose brands include Louis Vuitton, Christian Dior, Kenzo, Mark Jacobs and Donna Karan, has won a €40 million case in the French courts against eBay for failing to prevent the sales of fake perfumes on the auction site. The court also said that eBay had also breached LVMH’s selective distribution agreements on a number of perfume brands. Ebay plans to appeal on both counts, stating that LVMH was operating restrictive practices.

The LVMH Group issued a press release on Friday announcing the Paris Court of Appeal's decision to confirm the charges against eBay of the Paris Commercial Court. The French Commercial Court had ordered eBay to pay almost 40 million euros to LVMH for "negligence" and "illicit sales" over the sale of counterfeit goods on its online auction site. Through an injunction, the court also ordered eBay to cease selling perfumes and cosmetics bearing the Dior, Guerlain, Givenchy and Kenzo brand names, failing which eBay would incur penalty payments of Euro 50,000 per day. The Commercial Court had also ruled that eBay should prevent its members from using those brand names.
