Law360, New York (November 11, 2008) -- A federal judge has denied post-trial motions seeking to invalidate two of four patents-at-issue in an infringement suit against Fairchild Semiconductor International Inc., just weeks after the company failed to show all four patents-in-suit were unenforceable for inequitable conduct.

jerico.dev writes "I am currently selecting a CM tool for a project. Important condition: the software must be OSI compliant. I considered Alfresco, since they call themselves 'open source.' Then I heard from several of Alfresco's partners that they are not allowed to do projects based on Alfresco's GPL edition because their partnership contract denied them the right to do so. They only can support Alfresco's enterprise edition. But Alfresco's VP of business development Matt Asay told me that their enterprise edition is not OSI compliant. Does anyone in the Slashdot crowd have experience with partner contracts of other OSS vendors? Is it normal that Sun, Red Hat, etc. force their partners to decline projects based on their open source editions? It's probably legal to do so, but do you think it is legitimate and fair?"

Our testing has confirmed that iPod Touch users do not get updates to their Google Maps app with firmware 2.2, which, at least on the iPhone, includes the addition of Street View as well as public transit and walking directions. The updated browser interface, podcast downloading and assorted other tweaks are all there, as was the requisite sacrificing of any jailbreak apps. Of course there may be a perfectly reasonable explanation for this, but until that's given, Apple, it's all pitchforks and torches. Or iPods and forums posts, I guess. [MobileCrunch]

On Friday public officials said they were backing away from plans to publicize a new round of investments in about 22 large regional banks over concerns that firms not on the list would be perceived as unhealthy and would spark a panic among customers and shareholders. Banks will now be free to make their own announcements as PNC did when it said it would use $7.7 billion of government bailout money to help it acquire National City.

One of the most ridiculous extensions of patent coverage in the past few decades was the decision to allow patents on "genes" for those who discover the genes. Patents aren't supposed to be allowed for things occurring in nature, and it's difficult to see how that doesn't apply to something as basic as genes. Yet, as an anonymous reader wrote in to point out, down in Australia, a company with a patent on a specific gene is causing babies with a severe form of epilepsy to have to delay both diagnosis and treatment. In fact, the delay in treating the babies may miss the sweet spot for treating the disease and preventing brain damage. When patents are being used to stop diagnosing a patient with a serious disease, we should all be asking how the system went so wrong.

VTB has received no share swap proposals from the UK-based bank Barclays, Russia's Deputy PM and Finance Minister Alexei Kudrin told journalists today. He added that no such proposals have been submitted to the Russian bank's supervisory board. This statement was made in response to today's media reports that Barclays could swap a small stake (nearly 5 percent) with a major Russian state-run bank. Sberbank was said to have considered such a possibility, but its supervisory board declined the deal. It has also been suggested that the share swap could take place between Barclays and VTB.
