Jack Repenning, CTO of Collabnet, takes issue with my complaint that contributing code to open-source projects is hard. Jack's suggestion that "while community membership requires more than 'casual contribution,' you shouldn't have to 'become a key member'" in order to play a part is fair and spot-on. Unfortunately, it doesn't really tackle the big issue.

An anti-piracy organization called The PAK Group was formed last year for the purpose of gathering information about online copyright violations in order to pursue lawsuits for theft. The organization started out primarily pursuing illegal p2p sharing in a manner similar to RIAA. However they have now re-focused their efforts to target websites that have large amounts of copyrighted material on them. Specifically, they are looking to crack down on porn websites that are using copyrighted smut, sites like all of the “tubes” that you have modeled themselves after YouTube but which are all porn content. To crack down on these sites The PAK Group uses software to spider websites and find specific content that has been stolen; they are documenting the information in an organized plan to pursue litigation attacking the porn thieves.

Everyone familiar with this space hears about these kinds of tools and services all the time in the abstract, but the Post blog includes screen shots and background details on the popularity of the services and how each one is helping to bring cyber crime that much closer to the realm of even the most newbie scam artists." Many of these tools require a working knowledge of Russian. Wouldn't surprise me to learn that Chinese-language tools exist too.

While plenty of folks are talking about the cracking of Sarah Palin's personal email account, the EFF is noting that the Justice Department's own interpretation of email privacy laws may actually make it difficult to prosecute the hacker under the most obvious statute, the Stored Communications Act. You see, since the DOJ would prefer that your email not be considered private, it has interpreted emails that you've opened, but not deleted, as not being subject to the SCA. That's thanks to a somewhat contorted reading of the law that suggests that an opened email is no longer considered either in temporary or intermediate storage -- nor is it considered saved for backup purposes.
