Major League Baseball is crying foul over an Apple iPhone App called Baseball that it says infringes on MLB trademarks. At issue is Baseball’s use of MLB team logos inside the application. The free Baseball application for iPhones debuted last Friday as one of hundreds of applications available through iTunes App Store. Baseball, published by Bulbous Ventures, is a reference utility packed with baseball statistics dating back to the 1888 Detroit Wolverines all the way up to San Francisco Giant Barry Bonds’ 2007 battering average of .276.

An attempt to create an open-source set of public safety protocol cards has run into a legal setback after a commercial company issued an Internet cease-and-desist order that claimed copyright infringement. The cards were developed by the Open ISES Project, which has also developed an open-source CAD software application, and posted on-line just last March. However, last week the group says it received a letter from attorneys representing Medical Priority Consultants, who apparently stated that the open source cards infringed on the company's copyrights. In response, the Project took down the cards, and issued a statement explaining their actions. "We are hoping that we can work out an agreement with them. However, until such time, we had to take the site and associated files down," said Robert Austin, who manages the Project.

Over and over and over again, we hear stories of companies that simply dislike what others are saying about them online, and send over threatening legal letters with no legal basis. These cease-and-desist letters are mostly designed to scare users into giving in, because there's no law against someone criticizing you or saying something bad about you (assuming it's not untrue). The latest, sent in by Davis Freeberg involves the Everyday Finance blog. The blogger there was approached by a company called "Shop to Earn," which offers a multi-level marketing (MLM) system. The blogger wrote a post about it, which Davis Freeberg describes as "well balanced," though the blogger explained the weaknesses of the system and why he chose not to participate.
