Apple, CBS sued by device-maker over 'Mighty Mouse' trademark

Apple, maker of the iPod media player, and CBS were sued for trademark infringement by closely held computer-accessory firm Man & Machine over the name of Apple's wireless "Mighty Mouse" device. Apple started selling computer mice under the name "Mighty Mouse" more than a year after Man & Machine began selling waterproof and chemical-resistant computer mice to labs and hospitals under that name in 2004, according to the suit filed Tuesday in Greenbelt, Md. Man & Machine claims its earlier use trumps Apple's, even though Apple sells more products. The names of both products play on the 1942 animated super hero mouse whose trademark rights are partly owned by CBS. New York-based CBS is accused of licensing "Mighty Mouse" to Apple for computer devices when its trademark doesn't cover such goods.

Apple: iPhone sold out online in US, UK

SAN FRANCISCO (AP) - Apple Inc. said Monday its online stores in the U.S. and U.K. are sold out of the iPhone, a sign supplies are being winnowed ahead of the launch of the device's next generation featuring faster Internet surfing speeds. The Cupertino-based company confirmed that the iPhone is out of stock online, but added that brick-and-mortar stores run by Apple and iPhone carriers including AT&T Inc. might still have units available. Apple has been known for clearing out its inventory of a certain product ahead of a major upgrade. Apple spokeswoman Natalie Kerris declined to comment on reasons for the shortage and on Apple's plans for an update to the device, which is widely expected to be unveiled in June at Apple's Worldwide Developers Conference in San Francisco.

66% Apple Market Share For Sales of High-End PCs

An anonymous reader lets us know about a recent analysis of retail computer sales numbers that shines a spotlight on Apple's sales growth as the PC market has flattened. In the lucrative >$1,000 PC segment, in the first quarter of 2008, Apple's retail market share was 66%. This includes a 64% market share for laptops and a market share for desktops of 70%. The article attributes the bulk of this success to Apple's stores. Fortune picked up this report and pointed out the somewhat obvious fact that the >$1,000 PC segment is Apple's by default, since Dell, HP, and Lenovo sell the bulk of their machines in the $500-$750 range, and Apple has only one model selling for less than $1,000. Apple Not Selling iPhones in Canadian Apple Stores on Launch Day

Apple's apparently so fed up with the high pricing that Rogers is shoving into Canadian iPhone owners' faces that there will be no iPhone 3Gs sold at Apple Stores in Canada this Friday. This follows up Apple's previous action of diverting stock from Canada to Europe, and really sets the tone that they're unhappy with Rogers' $60 for 150 minutes, 75 SMS messages and 400MB data plan. So what's the deal? Canadians who still want one will have to line up early to get one of the 10-20 units per store that Rogers is getting. Apple sues Atico over patents for iPod accessories

Apple, the maker of the iPod media player, sued Atico International USA claiming it infringed five patents for accessories used with the device. Apple seeks a jury trial and an order to stop Atico from selling infringing products in the United States, according to papers filed yesterday in federal court in Wilmington, Del. Apple also alleges trademark infringement and unfair competition. "The iPod's success has spawned an enormous demand for iPod-compatible accessories" including docking stations, speakers and cables, Apple said in the complaint. Atico is selling unlicensed versions of the products, costing Apple money and harming its reputation, the company said. The patents cover accessory designs and a system for transferring information.

When the news broke in April that Apple had purchased low-power chipmaker PA Semi, savvy Apple watchers quickly zeroed in on the reason for the purchase that seemed to make the most sense: Apple could use PA Semi's extremely talented team of experience low-power processor designers to make chips for its iPhone and iPod lines. (The other option, that Apple would somehow use PA Semi's dual-core PowerPC products, was never realistic.) Apple Stores across country holding Black Music Month concerts

One of the things that sets Apple apart from other retailers is the in-house music events they hold at their stores, which include the iTunes Live concerts series. This month, in recognition of Black Music Month, Apple stores are hosting a variety of concerts around the country featuring various African American artists. The concerts are being held primarily in larger cities such as Atlanta, Miami, Chicago, San Francisco, New York, and Santa Monica. Man & Machine Sues Apple For "Mighty Mouse" Trademark Infringement

Apple Inc. picked up a new lawsuit this week, as Man & Machine, a computer peripheral company, sued Apple and CBS over Apple's use of the name "Mighty Mouse" for its Macintosh mouse. Man & Machine have been manufacturing and marketing a water and chemical resistant mouse under the same name since 2004, approximately one year before Apple introduced its own Mighty Mouse.

Online Apple Store Officially Sold Out of iPhones

We've been hearing about iPhone shortages for a while now, including dwindling supplies in the U.K. at both O2 and Carphone Warehouse, as well as limited stock at certain physical Apple retail locations here in the U.S. Well, that shortage apparently spread to Apple's U.S. and U.K. online stores over the weekend. As of Sunday, both online stores list the 8- and 16-GB versions of the device as "currently unavailable." A quick check of the Apple's refurbished store reveals there are no iPhones for sale there either. Could this mean the 3-G version of the phone will see a sooner than expected release date, or is Apple simply trying to minimize the inevitable bitchfest that will come from those still planning to purchase first-gen iPhone over the next few weeks?
