Applied Nanotech Holdings, Inc. (OTCBB: APNT) announced that the U.S. Court of Appeals for the Fifth Circuit issued its opinion in its litigation with Canon, Inc. The appeals court in part affirmed, and in part reversed, the rulings of the district court. While the appeals court accepted, without deciding, the district court's decision that SED, Inc. as originally formed did not qualify as a Canon subsidiary, and that Canon had materially breached the contract, it found that termination of the license agreement was not an appropriate remedy. The appeals court also ruled that the restructured SED, Inc., which is 100% owned by Canon, now qualifies as a Canon subsidiary. The appeals court denied Applied Nanotech's appeal that the district court had improperly excluded certain evidence from the trial.

fahrbot-bot tips a story of mad cow disease, a private meat packer that wants to test all of its beef for the disease, and the USDA, which controls access to the test kits and just won an appeals court ruling that the government has the authority to block testing above and beyond the 1% the agency performs. Creekstone Farms Premium Beef sought to test 100% of its beef, in order to reassure its export markets, especially Japan and South Korea, that its beef is safe. Large meat packers opposed any such private testing, because they feared they would be forced into 100% testing and would have to raise prices. To no one's surprise, ISO says that there was nothing wrong with the process. Groklaw's coverage is (as usual) the most comprehensive. Andy Updegrove summarizes ISO's position this way: "1. All judgments made during the course of the process were appropriately made under the applicable Directives. 2. The fact that the BRM voted on all proposed resolutions in some fashion satisfies the requirements of the Directives. 3. The fact that a sufficient percentage of National Bodies (NBs) ultimately voted to approve DIS 29500 ratifies the process and any flaws in that process. 4.
