Cabinet approves amendment to the Copyright Law

The Cabinet yesterday approved an amendment to the Copyright Law (µÛ§@Åvªk) that would authorize Internet Service Providers (ISPs) to take down content on their servers that infringes on the copyright of original creators.

Border guards testify that they saw child pornography on the defendant's laptop when the PC was on, but they made the mistake of turning it off and were unable to access it again because the drive was protected by PGP. Although prosecutors offered many ways to get around the 5th Amendment protections, the Judge would have none of that and quashed the grand jury subpoena requesting the defendant's PGP passphrase. A conviction is still likely because prosecutors have the testimony of the two border guards who saw the drive while it was open.

I agree that an anti-spam law should not outlaw anonymous non-commercial speech. But the decision contains statements about IP addresses, domain names, and anonymity that are rather basically wrong, and which may enable the state to win on appeal. The two basic errors are: concluding that anonymous speech on the Internet requires forged headers or other falsified information (and therefore that a ban on forged headers is an unconstitutional ban on anonymous speech), and assuming that use of forged headers actually does conceal the IP addres
