TechDirt has an insightful article on the recent push for ISPs to turn off Usenet access under the guise of fighting child pornography. Unfortunately, the "stand against child porn" isn't actually a stand at all, it seems more like ignoring the issue while trying to snag some headlines and good will. "Taking a stand against child porn wouldn't be overly aggressively blocking access to internet destinations that may or may not have porn (and there's no review over the list to make sure that they're actually objectionable). Taking a stand against child porn would be hunting down those responsible for the child porn and making sure that they're dealt with appropriately... Why The 'Third Party Doctrine' Undermines Online Privacy Protections

There's been an interesting discussion going on between my colleague Jim Harper and legal scholar Orrin Kerr about the third party doctrine, the legal principle that, in effect, you lose your Fourth Amendment rights when you relinquish information to a third party. The doctrine has become increasingly important with the rise of modern technology because we now entrust a host of private data -- including our email, cell phone calling data, credit card transactions, and more -- to private companies, and the third party doctrine would seem to suggest that Fourth Amendment protections would not extend to such information. A couple of weeks ago, Kerr posted a draft paper defending the doctrine, arguing that it brings clarity and simplicity to privacy law and avoids the need for "a complex framework of sui generis rules.

A US firm said on Wednesday it had filed legal actions against Japanese-based Nintendo claiming patent infringement by the wildly popular Wii game console.

The Major League Baseball association is seeking action against a free iPhone application called Baseball (opens in iTunes), regarding its use of MLB team logos throughout the app. PC World reveals the app contains thousands of team and player statistics, reaching back to 1888, all the way until the current baseball season. On Monday, Mark Knopper – owner and proprietor of Bulbous Ventures – was instructed by email to remove all logos related to Major League Baseball, and associated teams.

Autobytel Hires New CTO

Irvine-based Autobytel announced today that the firm has appointed Michael Hunsche as the firm's Chief Technology Officer. Hunsche has also served at KinderCare Learning Centers, The Walt Disney Company, and Anthem Blue Cross Blue Shield.
