Wi-LAN adds LG to its patent lawsuit

Intellectual property holder Wi-LAN Inc. has added LG Electronics Inc. of South Korea to patent litigation it previously filed against Research In Motion Ltd., Motorola Inc. and UTStarCom Inc. Wi-LAN, which launched the original suit in Texas on June 20, claims that all the defendants have infringed and continue to infringe on two U.S. patents it holds related to mobile handheld devices and other equipment. Wi-LAN, which has a stock market value of about $180-million compared with RIM's $67.7-billion and Motorola's $16-billion (U.S.), holds about 300 issued or pending patents, ranging from the television content filtering V-chip to an array of wireless telecommunications technologies. The amended lawsuit in U.S. District Court for the Eastern District of Texas adds LG Electronics Inc.

Wi-LAN to drop TI in patent suit

Wi-LAN Inc. has announced that Texas Instruments Inc. will be dismissed from Wi-LAN's legal action No. 2:07-cv-474 in the U.S. District Court for the Eastern District of Texas. The parties have also consented not to take any further proceedings against each other with respect to the Wi-LAN patents at issue in that action, for an agreed period of time. Despite this agreement, Wi-LAN will still have the right to seek damages from, or bring a future lawsuit against, TI for infringement of these patents.

Patent licensing firm, Wi-LAN has settled the pending patent litigation with Canada's Research in Motion (RIM) and updated its 2008 financial guidance as a result of recent license signings. As a result of the legal settlement, RIM has obtained a license to certain patents of Wi-LAN in the area of wireless technology and the litigation between the two companies will be dismissed.

Supreme Court strengthens patent exhaustion doctrine

The United States Supreme Court has unanimously held in Quanta Computer, Inc. v. LG Electronics, Inc. that the patent law cannot be used to control the subsequent use or disposition of a product "that substantially embodies a patent" once the product has been sold with authority of the patent owner. "The authorized sale of an article that substantially embodies a patent exhausts the patent holder's rights and prevents the patent holder from invoking the patent law to control post-sale use of the article." Patent exhaustion applies whether the patents are directed to products or methods. "Our precedents do not differentiate transactions involving embodiments of patented methods or processes from those involving patented apparatuses or materials.

Technology licensing firm Wi-LAN Inc said yesterday, August 11, that it has settled a pending patent lawsuit with BlackBerry maker Research In Motion.

We study how fragmentation of patent rights (‘patent thickets’) and the formation of the Court of Appeal for the Federal Circuit (CAFC) affected the duration of patent disputes, and thus the speed of technology diffusion through licensing. We develop a model of patent litigation which predicts faster settlement agreements when patent rights are fragmented and when there is less uncertainty about court outcomes, as was associated with the ‘pro-patent shift’ of CAFC. The model also predicts that the impact of fragmentation on settlement duration should be smaller under CAFC. We confirm these predictions empirically using a dataset that covers nearly all patent suits in U.S. federal district courts during the period 1975-2000. We've been covering the ongoing saga of an old patent we've referred to as the "JPEG Patent." CHICAGO (Business Wire) -- Neutral Tandem, Inc. (NASDAQ:TNDM) is attempting to limit competition in the telecommunications market by filing a patent infringement lawsuit against Peerless Network, LLC, a growing competitor in the field, according to a court filing made on behalf of Peerless Network by Kelley Drye & Warren, its counsel.
