Dave writes in with an interesting story suggesting that Major League Soccer is potentially violating the DMCA by issuing a takedown of footage for which it does not own the copyright. The details are a little confusing, and some parts aren't entirely clear -- but from the account at the link, two Major League Soccer teams participated in a separate tournament, called the U.S. Open Cup. The event was not televised at all, despite efforts among fans to provide a streaming webcast. Apparently, at the soccer match, a fight broke out, and the local news covered it, using footage from the game. Following this, some bloggers posted the news stations' story about the fight on YouTube -- at which point MLS sent a DMCA takedown notice. The question is whether or not MLS has copyright over the footage (MLS's trademarks are meaningless here, as the

Last year, we wrote about the case where Universal Music sent a takedown notice to YouTube when a woman posted a short (29-second) video of her toddler running around with a Prince song (barely audible) in the background. Universal backed down when challenged on the takedown notice, but the woman (with the help of the EFF) hit back and have sued Universal Music for a false takedown.

The saga of the copyright-infringing toddler continues as a California court refused to dismiss a lawsuit claiming that Universal Music had filed an improper takedown notice under the Digital Millennium Copyright Act. The DMCA provides a mechanism for copyright holders to demand the removal of infringing material on the web, but it also allows lawsuits against those who abuse that authority. Universal claims that it has no obligation to take fair use into account before sending its takedown notices, but Judge Jeremy Fogel rejected this argument—and with it, Universal's request to dismiss the lawsuit.

eldavojohn recommends coverage at Ars on a Byzantine case just thrown out by an appeals court. The US Air Force cracked the code that would expire a piece of software. For this they were sued under the DMCA in Blueport v. United States. The Court of Federal Claims heard it and threw it out. "The reasoning behind the decisions focuses on the US government's sovereign immunity, which the court describes thusly: 'The United States, as [a] sovereign, "is immune from suit save as it consents to be sued... and the terms of its consent to be sued in any court define that court's jurisdiction to entertain the suit."' ... 'The DMCA itself contains no express waiver of sovereign immunity,' the judge wrote, 'Indeed, the substantive prohibitions of the DMCA refer to individual persons, not the Government.

ABU DHABI: The Abu Dhabi Cricket Council has ruled itself out of hosting the proposed ICC Champions League Twenty20 Tournament. The capital of the United Arab Emirates (UAE) was a potential venue for the proposed eight-team event, featuring the top two teams from domestic competition in Australia, England, South Africa and India. The tournament is scheduled to be held in the 10-day window between the ICC Champions Trophy in Pakistan and India’s first Test against Australia in October. But Dilawar Mani, the president of the Abu Dhabi Cricket Council, said the UAE would not be able to host the event this year as at least two venues are required. “We are happy that Abu Dhabi has been named as a potential venue for the Champions League but I am afraid the event may not come to the UAE this year,” Mani told Gulf News.
