Is Major League Soccer Sending False DMCA Takedown Notices?

Dave writes in with an interesting story suggesting that Major League Soccer is potentially violating the DMCA by issuing a takedown of footage for which it does not own the copyright. The details are a little confusing, and some parts aren't entirely clear -- but from the account at the link, two Major League Soccer teams participated in a separate tournament, called the U.S. Open Cup. The event was not televised at all, despite efforts among fans to provide a streaming webcast. Apparently, at the soccer match, a fight broke out, and the local news covered it, using footage from the game. Following this, some bloggers posted the news stations' story about the fight on YouTube -- at which point MLS sent a DMCA takedown notice. Major League Baseball is crying foul over an Apple iPhone App called Baseball that it says infringes on MLB trademarks. At issue is Baseball’s use of MLB team logos inside the application. The free Baseball application for iPhones debuted last Friday as one of hundreds of applications available through iTunes App Store. The saga of the copyright-infringing toddler continues as a California court refused to dismiss a lawsuit claiming that Universal Music had filed an improper takedown notice under the Digital Millennium Copyright Act. The DMCA provides a mechanism for copyright holders to demand the removal of infringing material on the web, but it also allows lawsuits against those who abuse that authority. Universal claims that it has no obligation to take fair use into account before sending its takedown notices, but Judge Jeremy Fogel rejected this argument—and with it, Universal's request to dismiss the lawsuit.

MLB orders action against Baseball iPhone...

The Major League Baseball association is seeking action against a free iPhone application called Baseball (opens in iTunes), regarding its use of MLB team logos throughout the app. PC World reveals the app contains thousands of team and player statistics, reaching back to 1888, all the way until the current baseball season. On Monday, Mark Knopper – owner and proprietor of Bulbous Ventures – was instructed by email to remove all logos related to Major League Baseball, and associated teams.

A federal judge gave more weight to the concept of "fair use" when he threw a lifeline to a Pennsylvania mother's lawsuit against Universal Music. UAE will not host Champions League Twenty20 Tournament

ABU DHABI: The Abu Dhabi Cricket Council has ruled itself out of hosting the proposed ICC Champions League Twenty20 Tournament. The capital of the United Arab Emirates (UAE) was a potential venue for the proposed eight-team event, featuring the top two teams from domestic competition in Australia, England, South Africa and India. The tournament is scheduled to be held in the 10-day window between the ICC Champions Trophy in Pakistan and India’s first Test against Australia in October. But Dilawar Mani, the president of the Abu Dhabi Cricket Council, said the UAE would not be able to host the event this year as at least two venues are required. “We are happy that Abu Dhabi has been named as a potential venue for the Champions League but I am afraid the event may not come to the UAE this year,” Mani told Gulf News.
