Judge Rules for Video-Sharing Site in Copyright Case

A U.S. judge has thrown out a copyright infringement case against Veoh Networks Inc., an Internet video start-up with high-profile Hollywood backers, ruling that video-sharing companies are not solely responsible for policing piracy that may take place on their sites. The California court dismissed a copyright infringement suit by adult entertainment company Io Group Inc. against Veoh and granted summary judgment to the defendants.

NewYorkCountryLawyer writes "In an interesting development in a Texas case against a college-age defendant who was 16 at the time of the infringement, the Judge has denied the RIAA's summary judgment motion and ordered a trial of the damages — even though the defendant admitted copyright infringement using Kazaa — based on the 'innocent infringement' defense, which could reduce the statutory damages to $200 per song file. Relying on BMG v. Gonzalez (PDF), the reasoning of which I have criticized on the 'innocent infringement' issue, the RIAA argued that Ms. Harper does not qualify for the 'innocent infringement' defense, since CD versions of the songs, sold in stores, have copyright notices on them. UK Looks To Increase Penalties For Commercial Online Copyright Infringement 10X

When the "Gowers Report" on copyright first came out in the UK, we pointed out that it had a lot of bad ideas included. The one good point was that copyright length shouldn't be extended any more. So, now that the UK is planning to ignore that one good suggestion, it's moving forward with plans to implement the bad suggestions in the report -- such as increasing the fines for online copyright infringement by 10x. To be fair, this is focused just on "commercial-scale" copying where someone is profiting from the infringement. But, given how the recording industry works, how long until they look for ways to expand that definition or increase the fines for "personal copying" to keep them "more aligned" with the fines for commercial copying?

Judge upholds $107,834 in attorneys' fees award against RIAA

One of the most closely-watched file-sharing cases is a step closer to an end. A federal judge has awarded exonerated RIAA defendant Tanya Andersen $107,834 in attorneys' fees, a figure that isn't exactly what either party wanted. Andersen, a single mother in Oregon, was accused by the RIAA in 2005 of sharing music over KaZaA. Andersen denied the charges, filed a countersuit, and the RIAA finally dismissed the lawsuit last summer. Once the RIAA dismissed the case, she sought and won an attorneys' fees award as the prevailing party.

Innocent Infringement Defense May Work for RIAA Victim - Fines still high but symbolizes setback for RIAA

There is a college student in Texas who has been battling RIAA in one of the organization’s lawsuits against copyright infringement. The student was found guilty of illegal filesharing and downloads through Kazaa when she was just 16. She has pled guilty to illegal downloads but has asserted an “innocent infringement” defense alleging that she didn’t know that she was doing anything illegal. RIAA fought the defense with the argument that there are copyright notices on the CDs sold in stores and therefore that she should have known that she was violating copyright laws. The courts have ruled against RIAA in this instance. This doesn’t mean that all is good for the filesharer; the fine could still be as much as $200 per infringement.
