Dorel to pay $3.4-million to Mattel in patent case

Dorel Inc. has been ordered by a U.S. court to pay $3.4-million (U.S.) to Mattel Inc. for violating trade patents. The ruling, issued May 5 by the Delaware District Court, stemmed from a lawsuit initiated in 2001. Montreal-based Dorel has no plans to appeal, spokesman Rick Leckner said. Mattel argued that two Safety 1st products - Magic Motion and 2-n-1 Bouncenette - violated some patents. Dorel purchased Safety 1st in 2000. In an initial ruling in August, 2003, the court imposed an injunction prohibiting Dorel from manufacturing and marketing the products. A jury decision in 2007 found the violation was "voluntary" and ordered Dorel to pay $1.3-million in damages. Delaware Court Justice Gregory Sleet confirmed the award and added $1-million for damages before 2003 and $3.

VocalTec Communications To Sell Patents For $12.5 Million

May 28, 2008 (FinancialWire) VocalTec Communications Ltd. (NASDAQ: VOCL) (Current Market Cap. US$3.84 Mil.) has signed a patent purchase agreement to sell selected patents to Karo Millennium J.P. L.L.C. Other companies trading in VocalTec s industry include AT&T Inc. (NYSE: T), Verizon Communications Inc. (NYSE: VZ), an BCE Inc. (NYSE: BCE). Pursuant to the PPA, VocalTec will sell 11 patents and certain patent-related rights, out of the company s current portfolio of 22 patents, for the aggregate selling price of $12.5 million. The patents to be sold consist of nine US patents, one Israel patent, and one Australian patent. Consummation of the transaction is subject to certain conditions, including approval of the Office of the Chief Scientist of the Israeli Ministry of Industry, Trade and Labor.

May Sales Down 1% For Tandy Leather Factory

June 5, 2008 (FinancialWire) Tandy Leather Factory, Inc. (AMEX: TLF) (Current Market Cap: US$ 34.36 Mil.) said that its sales for the month of May were $4.5 million, down 1% from May 2007 sales of $4.6 million. The company s year-to-date sales are down 4% to $22.6 million in the current year from $23.5 million last year. The company s Retail Leathercraft segment posted an 8% sales increase for May, with sales totaling $2.0 million compared to $1.9 million in May 2007. The 67 comparable stores posted a 3% same store sales gain for the month. Five stores that opened in or after May 2007 added sales for the month of $86,000. Year-to-date sales for Retail Leathercraft are $10.4 million this year, up 3% over last year's sales of $10.1 million. As of the end of May, same store sales were down 3% for the year.

Google tops Web audience rankings

Nielsen Online has reported May 2008 data for the Top Sites by Parent Company and Top Brands. Google tops the list with 127 million unique visitors. Microsoft is close behind with 123 million, while Yahoo! comes in third at 115 million. Time Warner pulled 107 million visitors, News Corp. Online 79 million, eBay 66 million and InterActiveCorp 64 million. Wikimedia Foundation, Amazon and New York Times round out the list with between 50 and 60 million unique visitors. The data indicate that, for example, that 51.1 million home and work Internet users visited at least one of the New York Times Company-owned sites or launched a New York Times Company-owned application during the month, and each person spent, on average, a total of 17 minutes and 27 seconds at one or more of their sites or applications.

Income from operations for the second fiscal quarter 2008 was $2 million, compared to a loss from operations of $12 million for the second fiscal quarter 2007. Income from continuing operations in the second fiscal quarter 2008 was $6 million, or $0.02 per share. This compares to a loss from continuing operations of $1 million, or $0.00 loss per share, for the second fiscal quarter 2007. Foreign currency exchange rates favorably impacted revenue by $8 million, unfavorably impacted operating expenses by $9 million and negatively impacted income from operations by $1 million yearover- year.

New web site planned to trade US biofuels in eBay fashion

A company that specializes in online casinos announced this week it was taking a gamble on the US biofuels industry by launching a new web site devoted to the buying and selling of ethanol and biodiesel. USBiofuelsExchange.com (US-BX) opened Tuesday to "pre-register" producers, resellers and buyers, according to a statement from Diamond I, a development-stage company seeking to change its name to US BioFuels Exchange Inc. The official launch will probably take place later this summer after beta-testing, said James Kaufman, managing director of US-BX, in an interview. The site will seek to level the playing field for biofuels producers in the US, he said, noting "long-standing arrangements" between big producers and buyers have posed "constraints" for smaller players without the clout to lock in those sorts of deals.

The most well known example of a trade secret is the formula for Coke. Every company, however, has trade secrets (e.g., customer lists, source code for software, methods of creating products, etc.). There are also federal laws that provide additional protection for trade secrets by way of severe civil and criminal penalties for theft or other misappropriation of trade secrets.

Mindspeed Sells Patents

Newport Beach-based Mindspeed Technologies announced today that it has sold what it describes as "certain non-core patents" for $10M. Terms and buyers of the patents were not disclosed. Mindspeed said the patents came from a broad portfolio of patents which are no longer core to the firm's business focus. Details on the types of patents sold and number of patents was not released by the company. Mindspeed said it has been generating revenue from patent sales in the last year, and expects to engage in additional "strategic, non-core" patent sale or licensing arrangements in the future.
