ASIP Holds “Patents of Inventions and Trade Secrets” Course

AMMAN - The Arab Society for Intellectual Property (ASIP) announced on Sunday that the registration for the third course of the Arab Certified Intellectual Property Practitioner (ACIPP) program entitled "Patents of Inventions and Trade Secrets" has started.

Trade Secrets and NDAs

Trade secrets are confidential business information that have value because they are not generally known and are the subject of efforts by the business to keep the information confidential. The most well known example of a trade secret is the formula for Coke. Every company, however, has trade secrets (e.g., customer lists, source code for software, methods of creating products, etc.). Every state has enacted laws to protect trade secrets. There are also federal laws that provide additional protection for trade secrets by way of severe civil and criminal penalties for theft or other misappropriation of trade secrets.

Former Hewlett Packard Vice President Pleads Guilty to Theft of IBM Trade Secrets WASHINGTON, July 11 /PRNewswire-USNewswire/ -- A former vice president of imaging and printing services at the Hewlett Packard Company (HP) pleaded guilty today to stealing trade secrets, announced Acting Assistant Attorney General Matthew Friedrich of the Criminal Division and U.S. Attorney Joseph P. Russoniello for the Northern District of California. Atul Malhotra, 42, of Santa Barbara, Calif., was charged on June 27, 2007, in a one count information with theft of trade secrets. According to court documents, from Nov. 17, 1997, to April 28, 2006, Malhotra was employed by International Business Machines Corporation (IBM) as director of sales and business development in output management services for IBM Global Services.

Court Clarifies Statute of Limitations for Trade Secrets

When it comes to determining liability for stolen trade secrets used by unsuspecting third parties, the question in litigation often becomes who knew what when? It has not always been clear when the statute of limitations for these third-party lawsuits begins ticking. Does it start when the trade-secret owner realizes its stolen intellectual property has been licensed to third parties? Does it begin when the trade-secret owner files a lawsuit against the company that stole the secrets and then licensed them to others? Or does it only begin counting down when third-party users are notified that they possess stolen IP?

Mindspeed Sells Patents

Newport Beach-based Mindspeed Technologies announced today that it has sold what it describes as "certain non-core patents" for $10M. Terms and buyers of the patents were not disclosed. Mindspeed said the patents came from a broad portfolio of patents which are no longer core to the firm's business focus. Details on the types of patents sold and number of patents was not released by the company. Mindspeed said it has been generating revenue from patent sales in the last year, and expects to engage in additional "strategic, non-core" patent sale or licensing arrangements in the future.

Invista sues Rhodia, Dupont for conspiracy, trade secrets theft

In US federal court, Invista sued Rhodia and DuPont who were allegedly teaming up to misappropriate Invista's adiponitrile (ADN) technology and unlawfully using the Invista's trade secrets to expand in the nylon chemicals business, Invista said in a news release Monday. The Invista trade secrets at issue relate to its proprietary process for producing adiponitrile, an intermediate chemical used in the manufacture of nylon 6,6. Invista bought the original technology several years ago from DuPont as part of a $4.2 billion transaction, Jarvis said. When it sold the technology to Invista, DuPont signed an agreement prohibiting it from competing against Invista or making investments in competitors for an agreed-upon period, which had yet to expire.

The right of appeal under the amended Patents Act: a case study

Before the Patents Act, 1970 was further amended by the Patents (Amendment) Act, 2002 and the Patents (Amendment) Act, 2005, a party may only oppose the grant of a patent by the Controller of Patents at the pre-grant stage; however, after the Controller has made a decision, a party may appeal against it in the High Court under section 116(2) of the 1970 Act. Patents facilitation centre opened

The Pharmaceuticals Export Promotion Council (Pharmexcil) announced the inauguration of a Patents Facilitation Centre here on Friday. Court Rejects Two Medtronic Patents

(NYSE: MDT) unenforceable for inequitable conduct during the prosecution of the patents before the United States Patent and Trademark Office. A jury had previously found that certain Boston Scientific balloon catheters and stent delivery systems infringed three Medtronic patents and that the patents were valid. Nokia and Qualcomm Come to Terms Over Patents

They were set to battle over the use of certain wireless patents, and instead were able to come to terms over patents covering GSM, EDGE, CDMA, WCDMA, HSDPA, OFDM, WiMax, LTE and other technologies. Under the terms of the new agreement, Nokia may use Qualcomm's patents in its chipsets and network infrastructure equipment, and Qualcomm may use certain Nokia technologies in its chips. Qualcomm also won the right to call several disputed WCDMA, GSM, and OFDMA patents its own. Nokia will make an upfront payment to Qualcomm and pay ongoing royalties, but the exact financial details were not disclosed.
