Apple sues tech over iPod trademark, fraud

After filing documents trademark documents concerning the use of "Pod" and "iPod" in products and advertising, Apple is pursuing a lawsuit against a Michigan iPod repair business, the iPod Mechanic. AppleInsider reveals that in 2006, Apple had warned business owner Nicholas Woodhams over the use of the terms, asking him to stop. Woodhams allegedly agreed, but did not follow through, and has now supposedly tipped the scales by committing fraud against Apple.

"Mac clone maker Psystar plans to file its answer to Apple's copyright infringement lawsuit Tuesday as well as a countersuit of its own, alleging that Apple engages in anticompetitive business practices. Miami-based Psystar... will sue Apple under two federal laws designed to discourage monopolies and cartels, the Sherman Antitrust Act and the Clayton Antitrust Act, saying Apple's tying of the Mac OS to Apple-labeled hardware is 'an anticompetitive restraint of trade,' according to [an] attorney... Psystar is requesting that the court find Apple's EULA void, and is asking for unspecified damages."

(Review) - Yesterday, we had the opportunity to review Apple's 3rd generation iPod Nano, and needless to say, we came away impressed with the latest carnation of the iPod family. Apple is too good at what it does, and it shows. Today, we have the iPod Classic in our lab, and unfortunately, we don't know what to write about. That means that the combined value of all Apple's outstanding shares of stock exceeded the combined value of all Google's outstanding shares of stock. Apple's stock is worth $157 billion and change vs. Google's $156 billion. Other companies Apple has surpassed in market cap include Cisco, HP, and Intel. Also, Apple is now worth 3 times the value of Dell Computer, despite Dell's founder and CEO declaring over a decade ago that if he ran Apple, he'd 'shut it down and give the money back to the shareholders.'"

Apple settles iPhone trademark dispute in Canada

Apple and Canada's Comwave Telecom have settled their trademark dispute over the use of the name "iPhone." The agreement was reached Wednesday night, with Apple retaining sole rights to the iPhone name in Canada, and Comwave phasing out its use of the name in reference to its Voice over Internet Protocol (VoIP) phone service by November 9. Further terms were not disclosed. The agreement, first reported by the Globe and Mail, ends a long battle between the two companies.

The Washington Post's Security Fix blog reports that Apple researcher Charles Edge was to present on flaws in Apple's FileVault encryption plan, but asked Black Hat to cancel the talk, citing confidentiality agreements with Apple. Then on Friday, Apple pulled its security engineering team out of a planned public discussion on the company's security practices — which would have been a first for Apple. 'Marketing got wind of it, and nobody at Apple is ever allowed to speak publicly about anything without marketing approval,' a Black Hat spokesman said."

Since I'm a Verizon Wireless customer the closest thing to joining the iFrenzy for the iPhone 3G is taking advantage of Apple's App Store and the wealth new software options available for my iPod Touch. The only problem (sound effect of vinyl record scratching) I can't run any applications from the just opened Apple App Store because I'm locked out. Worse, now that I've updated iTunes to 7.7, I can browse and salivate over applications compatible with my iPod Touch and even download them to my PC. The only problem is my iPod Touch firmware won't update to the latest 2.0 version available today. I've been stuck looking at the message "This version of the iPod software (1.1.4) is the current version."

(Review) - We couldn't wait to get our hands on the latest of Apple's iPod music players, as the company put on its annual show to update the most successful product line in its history last week. Needless to say, the industry is buzzing once again and for a good reason. We've got to be honest though. When Jobs first showcased the new line, our jaws dropped. We were horrified with the new designs. They appeared to be chubby, clunky and anything but sexy. Was Apple losing its touch with reality? Who would want an out of shape iPod? Certainly not us. But we were wrong. Boy, we were wrong. Just like with a lot of other Apple products, you can't truly get a feel for them with text, photos, audio and videos. You have got to see them in real life to truly appreciate their beauty.
