Nintendo Loses Controller Patent Lawsuit

kryogen1x alerts us to coverage at 1up indicating that Nintendo controller may soon become scarce — Nintendo lost in court to Anascape over analog sticks in their Wii and GameCube controllers.This isn't the first time the big manufacturers have been targeted in lawsuits involving features in their controllers. From the article: "The lawsuit concerns the analog sticks in the Classic Controller and GameCube controllers, which Texas-based Anascape Ltd. claims to hold a patent on that Nintendo violated. The court has ruled in favor of Anascape, and US District Judge Ron Clark has rejected Nintendo's request for a new trial. As a result, Clark said he will put a ban on the sale of the controllers (which includes sales of GameCube systems) starting tomorrow, July 23, unless Nintendo posts a bond or puts royalties into an escrow account.

Wow, was Nintendo's conference a bore-fest! More so in light of the amazing showing from Sony. The conference was underlined by a bizzare motto of 'smiles for everyone' -- lots of talk of audience expansion and paradigm shifts. Well, one paradigm-shifted seemed to be missing games, you know, those things we play on that Wii console thing? Nintendo did showcase four titles during its E3 2008 conference. These were:

Patent lawsuit aims to block Nintendo Wii in US...

Technology license holder Hillcrest Labs today sought to draw support for its cause by publicizing a lawsuit against Nintendo over its Wii console. The Maryland-based plaintiff claims that Nintendo's Wii remote is violating four US patents relating to a spatial controller and on-screen interface for content on TVs. The Japanese electronics maker is knowingly profiting from the Wii in the US without licensing the relevant technology, according to the complaint.

Several Nintendo Controllers may be Banned

Nintendo may soon have to halt sales of its Wii Classic Controller, GameCube WaveBird, and the standard GameCube controller. A suit was brought against Nintendo by Anascape for violating its patent for a "six degrees of freedom interface device." Sony has been licensing the technology since 2004 and Microsoft settled out of court. Nintendo, however, decided to go to trial, and the judge ruled that Nintendo was indeed in violation of the patent and not only owes $21 million, but may also have to halt sales of the three aforementioned controllers. Nintendo has appealed the ruling, so for now, they can continue to sell the controllers. However, if you've been considering purchasing one, you may want to do so sooner rather than later.

New web site planned to trade US biofuels in eBay fashion

A company that specializes in online casinos announced this week it was taking a gamble on the US biofuels industry by launching a new web site devoted to the buying and selling of ethanol and biodiesel. USBiofuelsExchange.com (US-BX) opened Tuesday to "pre-register" producers, resellers and buyers, according to a statement from Diamond I, a development-stage company seeking to change its name to US BioFuels Exchange Inc. The official launch will probably take place later this summer after beta-testing, said James Kaufman, managing director of US-BX, in an interview. The site will seek to level the playing field for biofuels producers in the US, he said, noting "long-standing arrangements" between big producers and buyers have posed "constraints" for smaller players without the clout to lock in those sorts of deals.

It seems that gaming controllers are the hot target for patent lawsuits, and patent holders are finding litigation a sound strategy. After Sony lost its case against Immersion and, along with Microsoft, coughed up a hefty sum of money, as well as also licensing the technology for use in the Dual Shock 3 controller, the other sharks had to have smelled the blood in the water. In August of last year a company called Anascape brought suit against Nintendo and Microsoft, claiming the companies violated an array of patents. While Microsoft settled the case for an undisclosed amount, Nintendo pressed on and the jury awarded Anascape $21 million in damages last year. Now this is interesting. Hillcrest Labs is suing Nintendo, trying to create an import ban on the Wii. They claim that Nintendo is infringing on a number of their patents relating to the Wiimote and the on-screen menu system on the Wii. The whole thing doesn't make a lot of sense to us, as we were under the impression that both Nintendo and Hillcrest Labs licensed their tech from Gyration. Nintendo's holiday games preview showed us nothing but fun for the Wii and DS. Ubisoft, Sony, and EA all showed off great games in the days prior to Nintendo's own preview, which focused on fun and ease of use over all else.

Nintendo profits up to $996 million thanks to the Wii and games

nintendo wii The revenue generating machine known as the Nintendo Wii keeps on chugging along as Nintendo announced fiscal first quarter profits surged 34 percent from the year-ago quarter. The company reported a profit of 107.27 billion yen (or $996 million U.S. dollars) during the quarter from April till June which was up from 80.25 billion yen last year.
