Over and over and over again, we hear stories of companies that simply dislike what others are saying about them online, and send over threatening legal letters with no legal basis. These cease-and-desist letters are mostly designed to scare users into giving in, because there's no law against someone criticizing you or saying something bad about you (assuming it's not untrue). The latest, sent in by Davis Freeberg involves the Everyday Finance blog. The blogger there was approached by a company called "Shop to Earn," which offers a multi-level marketing (MLM) system. The blogger wrote a post about it, which Davis Freeberg describes as "well balanced," though the blogger explained the weaknesses of the system and why he chose not to participate.

Two new publishers of children's books have sparked debate in gender-equal Sweden over their professed aim of instilling the country's open-minded social values in the next generation. But some critics are outraged, saying they are simply pushing propaganda disguised as literature. Small publishers Vilda and Olika opened their doors last year with the express aim of making children's books that promote liberal values and challenge traditional views on sex, race and sexual orientation. Together they have released about a dozen titles, including a book about a boy who wears pink sandals, and a story about a girl who likes to make farting sounds using her armpits, and who has two dads. "You cannot write a book simply because you want it to be gender equal," said Lotta Olsson, a literary critic at Sweden's paper of reference, Dagens Nyheter.

Reuters is running an article about how the Allman Brothers Band is suing Universal Music for apparently not paying the band royalties owed for iTunes downloads. This seemed like yet another example of a record label squeezing its artists, while insisting that it's always looking out for the artists' best interests. Of course, then I remembered that this isn't the first time this has come up with the Allman Brothers. More than two years ago, we wrote about the Allmans suing Sony over the same issue. At that time, there was a dispute over how the label was counting iTunes downloads, and which clause iTunes downloads fit under in the band's contract. This recent lawsuit seems like a similar dispute with Universal, but it does make you wonder why the band sued Sony back in 2006, but waited until now to sue Universal?

It would appear that Google is discovering some of the differences in the legal system in India as compared to the US. Just after we wrote about how Google (along with Microsoft and Yahoo) were sued over ads, there are some stories coming out about how an Indian court has ordered Google to hand over the identity of an anonymous blogger who was criticizing an Indian company, Gremach Infrastructure Equipments & Projects Ltd. While anonymous speech is somewhat protected (within certain limits) in the US, that's not the case in many other countries. As the link above notes, this may force Google to change the way it does business in India.

Online auction house eBay may have won a major court victory when it prevailed over Tiffany, but its legal troubles are hardly behind it. In that case, a judge ruled that eBay was taking reasonable efforts to keep counterfeit items off its site and used Tiffany's trademarked name appropriately, but the auctioneer lost a similar battle against Louis Vuitton in French courts. Now, word comes that a software industry group is considering suing the auctioneer over counterfeit items, this time on copyright grounds.
